Uncharted Tours (“The Company”) provides culturally immersive and responsible travel experiences. These Terms and Conditions form the agreement between The Company and any individual or entity booking with us (“The Client”). By making a reservation, The Client confirms that they have read, understood, and agreed to these Terms.
Contract Formation
A binding contract is established once The Company issues a booking confirmation via email or invoice. All participants listed under the booking are bound by this agreement. Services are limited to those explicitly outlined in the confirmed itinerary. No verbal promises or side agreements are valid unless confirmed in writing by The Company.
Eligibility & Fitness to Travel
All participants must be 18 years or older unless stated otherwise. Clients over 70 must provide a medical certificate confirming they are fit to travel. Travelers with pre-existing health conditions or who are pregnant beyond 20 weeks must notify The Company before booking. The Company does not provide medical advice; clients should consult a licensed physician regarding health and travel-readiness.
Deposit & Payment Schedule
A non-refundable deposit of $500 USD per person is required to confirm any booking. Full payment is due 60 days before the start date.
- Bookings made within 60 days require full payment within 2 days.
- Bookings made within 30 days require full payment immediately.
Unpaid balances may result in cancellation without refund.
Cancellation by Client
All cancellations must be made in writing. The following cancellation policy applies:
- 60+ days before start: Deposit retained, can be transferred to another trip.
- 31–59 days: 50% of total booking is non-refundable.
- 0–30 days: 100% non-refundable.
Add-on services (hotels, transfers, etc.) are refundable if cancelled 60+ days in advance. Cancellations within 60 days are non-refundable.
Cancellation by The Company
The Company reserves the right to cancel any trip with at least 60 days’ notice. If cancelled, The Client may choose from:
- A full refund.
- Transfer to a different trip (additional costs may apply).
- Retain paid value as credit for future use.
Trips may be cancelled on short notice due to force majeure. In such cases, refunds will exclude unrecoverable costs.
Force Majeure
Uncharted Tours is not liable for changes or cancellations caused by circumstances beyond our control, including but not limited to: natural disasters, political unrest, government regulations, pandemics, or airline strikes.
Amendments to Bookings
Changes requested by The Client after confirmation may incur additional charges. No amendments are allowed within 30 days of departure.
Travel Insurance
Travel insurance is mandatory. Proof of coverage must be presented before departure, including policy number and 24-hour emergency contact. Coverage must include medical expenses, emergency evacuation, trip cancellation, and personal liability (minimum $200,000 USD recommended).
Client Responsibility
The Client agrees to:
- Comply with local laws and customs.
- Respect cultural practices and our Positive Impact Travel guidelines.
- Accept the authority of trip leaders to make on-the-ground changes.
- Depart the tour at the leader’s discretion if they disrupt group dynamics or safety.
Optional Activities
Activities not included in the itinerary are undertaken at The Client’s own risk. The Company is not responsible for the safety or quality of third-party services.
Itinerary Flexibility & Alterations
The nature of travel requires flexibility. The Company reserves the right to make itinerary changes before or during the tour due to safety, weather, or local conditions. Significant changes will be communicated in advance when possible.
Unused Services
No refunds will be given for unused services or early departures initiated by The Client.
Prices & Surcharges
Tour prices are quoted in USD and subject to change due to currency fluctuation, inflation, or changes in supplier pricing. Increases above 8% entitle The Client to withdraw without penalty.
Documentation Requirements
The Client is responsible for holding valid travel documents, including a passport valid for 6 months beyond the trip end date, necessary visas, and vaccination records. The Company bears no responsibility for travel disruptions due to incomplete or invalid documentation.
Liability
Uncharted Tours works with third-party suppliers (hotels, guides, drivers, etc.) but is not liable for their acts or omissions. To the maximum extent permitted by law:
- We exclude all liability for any loss, damage, injury, or death not caused by our direct negligence.
- We are not liable for indirect or consequential damages.
- Where liability cannot be excluded, we limit our obligation to resupplying the service or refunding the cost.
Image Use
Photos or videos taken during the tour may be used by The Company for promotional purposes unless the Client requests otherwise in writing prior to the trip.
Data Privacy
Personal information is used solely to fulfill the trip and shared only with essential service providers. We do not sell or distribute your data to unrelated third parties.
Refusal of Service
The Company reserves the right to refuse service at its discretion for any reason deemed necessary to protect clients, staff, or the integrity of the experience, provided such refusal does not violate any anti-discrimination laws.
Severability
If any provision is deemed invalid or unenforceable, the remainder of these Terms shall remain in effect.
Governing Law
This agreement is governed by the laws of the jurisdiction in which Uncharted Tours is registered.
